THE TERMS
The terms described in this document
will be applied to all incentives
operated by AiWin.com and other website
owned and operated by AiWin Corporation.
This Incentive Terms and Conditions (the
"Terms") is entered into by and between
AiWin Corporation ("AiWin"), with its
principal place of business at Aiwin
Corporation: Unit B, 8/F., Eastern
Flower Centre, 22-24 Cameron Road,
Tsimshatsui, Kowloon, Hong Kong, and
eBiz Affiliate or eBiz Partner
("Subscriber"). Any reference herein to
the "Parties" will be a collective
reference to AiWin, eBiz Affiliate and
eBiz Partner.
I. MEMBERSHIP IDENTIFICATION
I. Valid Membership and Information.
(a) All subscribers shall be either eBiz
Affiliate or eBiz Partner member and who
shall also provide accurate and valid
information about their identity.
(b) A subscriber must have a valid email
address and a valid shipping address in
Canada, United States or a U.S.
Territory.
For enrolling the incentive programs, a
user must have a valid email address and
a valid shipping address in Canada, the
United States or a U.S. Territory.
Subscriber should also note that some
products cannot be shipped to PO Boxes.
We only allow one account per shipping
address. Providing any incorrect
information, including country, and
state or province, could result in delay
of shipping or denial of credit.
Where applicable, failure to select the
correct country may result in an account
being placed on hold.
(c) While offers for some regions may be
provided in languages other than
English, Subscribers agree that they
thoroughly understand written English
and are comfortable communicating in
English. Website information and
customer support is only available in
English at this time.
2. Accounts.
(a) Individual may not create multiple
accounts on the same website. For these
Terms of Use, AiWin.com, eBizOffice.net
and ShoppingFinder.com are considered
one website. Subscribers are allowed to
create a unique account with each
referral-based website, as all of these
websites are not linked together.
Subscribers are not allowed to have
multiple accounts within a single
referral-based website. All multiple
accounts found to be fraudulent and
which violate these Terms of Use will be
placed on hold.
(b) Only one account is allowed per
shipping address, per signup computer IP
address, per website. We do this to
ensure quality of competition and to be
fair to all subscribers. If there is
more than one user at a shipping address
or shared computer, we suggest that they
share an account. All accounts which are
found to contain shared shipping
addresses and/or computers will be
placed on hold. It is recommended that
you do not joining a AiWin website using
a shared computer or shared internet
access such as those found at a school,
office or public location. This may
result in you having the same IP address
as other Subscribers which will likely
result in all related accounts being
placed on hold. If you wish to join
using a campus internet connection,
please check to make sure you will have
a unique IP address. We suggest that you
use your own personal computer and
internet service provider.
(c) A single subscriber may not have
multiple accounts at more than one
shipping address or IP address on the
same AiWin website. For example, a user
may not have an account at a street
address and a PO Box. A single
subscriber may not use multiple
computers, internet service providers or
IP addresses to create multiple
accounts. For example, a user may not
create one account from a home computer
and create a second one from a work
computer.
(d) A subscriber may not use another
person's name or information to receive
products from this website. For example,
one person may not join the website for
another person, or complete offers for
another person's account.
(e) Collected credits cannot be
transferred between subscriber accounts.
(f) Each subscriber is personally
responsible for maintaining the security
of his or her account. A subscriber
should not share his or her account
information and is responsible for
keeping his or her password
confidential. AiWin is not liable for
any losses incurred through the access
of your account by a third party or the
disclosure of your password or account.
(g) Any subscriber who has his or her
account placed on hold may not create
another account on any of the AiWin
websites. All parties residing at the
same physical address as a subscriber on
hold will be affected by this mandate
and thus, will also be placed on hold
indefinitely.
3. Emails.
(a) AiWin sends a confirmation e-mail
with a link which must be clicked to
validate your membership account. If you
do not click this link your account will
not be created. If your account is
validated, you will receive an
additional mail to confirm this.
4. Termination of Account.
(a) The enrollment of incentive
program will only be terminated as long
as a subscriber's affiliate or partner
membership is terminated.
II. Completion
1. Completion of Sales
(a) Subscribers may only receive
credit for successful sales and referral
completions. For example, a subscriber
who refers a sale to eBizOffice.net and
input the affiliate or partner ID in
referral box on eBizOffice.net's
customer sign-up form in order that the
system can record the sales and credit
points to correspondent subscriber
account.
(b) According to the 30-day Money
Back Guarantee, your referral may be
completed as long as 30 days after the
sales.
2. Failure to be Credited for a
Sale
(a) AiWin does not guarantee that a
subscriber will receive credit for a
sale. We reserve the right to refuse
crediting a user for offer completion
for a variety of reasons, including, but
not limited to, lack of appropriate
information, incorrect address
information, improper sign-up method,
improper browser settings, immediate
cancellation of a sale.
(b) We are not responsible for delays
in reporting sales completion or failure
to receive referral credit. The time it
takes to receive credit varies greatly.
(c) The user is responsible for
saving all of the confirmation emails
they receive associated with sales
completion. We will not manually credit
a subscriber for a sale without
receiving a confirmation of sale from a
customer. A confirmation email is an
email that a customer receives from one
of eBizOffice.net and ShoppingFinder.com
after their order r have been fully
satiated. However, presenting a
confirmation email does not guarantee
that a subscriber will receive credit.
(d) We may require Subscribers to
present additional proof of sales
completion including, but not limited
to, screenshots of specific member
areas. We will never require Subscribers
to share third party password
information or personally identifiable
information not required to
substantiated a claim of sales
completion.
3. Eligibility for Receiving a
Prize Item
(a) For this particular website,
AiWin.com, Subscribers must do the
following to be eligible to get approval
to receive their award prize:
i. Complete and get credit for referring
sales themselves.
ii. Refer the required amount of unique
people who order and also correctly
complete an offer under the terms listed
in this document.

(b) Subscribers may only receive 1
prize items per account, per website.
(c) Subscribers must be residents of
Canada, United States or a U.S.
Territory and there can only be one
account per shipping address. Sales must
be completed for the country in which
the user is a resident. For example, a
Canadian or resident would not receive
credit for signing up for a US sales.
(d) If the total amount of items
received from AiWin is valued at more
than US$600, you will be required by
federal law and any applicable state law
to claim the value of your reward.
Therefore, an IRS W-9 form for US
residents or IRS W-8 form for non-US
residents will be provided to you via
email. This form must be completed in
its entirety and returned to AiWin in
order to receive your prize items from
us.
(e) If a user's local jurisdiction
requires taxes or fees to be paid in
association with receipt of free
products, the user shall be solely
responsible for the cost of such taxes
and/or fees. AiWin covers the cost of
purchasing an item, shipping an item,
and any original sales tax associated
with an item.AiWin will not cover any
additional costs not directly related to
purchasing and shipping an item.
III. SHIPPING
1. Receipt of Item
(a) After a subscriber completes the
steps required to receive the prize,
AiWin will take measures to ensure that
the subscriber receives prize within a
reasonable amount of time. Delivery
times vary amongst prize items, but most
shipment are received within 30 days
from placing the order.
(b) On occasion, prize items may be
back ordered or discontinued from our
supplier or their manufacturer. In cases
involving backordered items, items will
ship as soon as they are made available.
In cases involving discontinued items,
we will re-issue you credit so that you
can order another product of an
equivalent value on our website.
(c) After a subscriber receives a
prize, if we determine that he or she
fraudulently completed the requirements,
we have the right to take legal action
against the subscriber.
2. Delivery of Prize
(a) All shipment are mailed to the
address provided by the subscriber at
the time the subscriber sign up the
affiliate or partner membership account.
It is a subscriber's responsibility to
verify that the address provided is
correct. AiWin is not responsible for
lost shipment stemming from incorrect
shipping addresses, theft, or erroneous
deliveries. In the event that a
situation arises necessitating package
forwarding, AiWin is in no way
responsible for ensuring delivery.
(b) If a subscriber does not receive
a prize item, he or she should make sure
that they have waited the appropriate
time period and confirm that the
shipping address given is indeed
correct. In the event that an item is
lost, AiWin will make a reasonable
effort to track the package and replace
it if necessary.
(c) For any item that has confirmed
delivery via a tracking number, AiWin
will not resend the shipment or refund
the points back to a subscriber's
account. If an item is lost, a
subscriber can only receive a
replacement item and cannot receive his
or her points or credit back. We reserve
the right to refuse a replacement
shipment or point or credit refund.
(d) If a subscriber has received more
than one order at a shipping address,
AiWin has the right, at any time, to
refuse future delivery to that address.
(e) Product items listed on our
websites will come with complete
warranties.
3. Availability of Product
(a) On occasion, product items that
appear on our websites may be back
ordered or discontinued from our
supplier or their manufacturer. In cases
involving backordered products, product
items will ship as soon as they are made
available. In cases involving
discontinued products, we will re-issue
you credit so that you can order another
product of an equivalent value on our
website.
4. Return Policy
(a) In the case of an error or mistake
by AiWin whereby a wrong product item
was shipped, we will make reasonable
efforts to replace the product.
(b) If a product is found to be
defective, the user should consult the
warranty information included with his
or her item. We are not responsible for
the repair or replacement of defective
products. Please contact the relevant
vendor for questions about damaged or
defective products you receive. In cases
where you do not know what vendor
shipped it to you, we can pass along the
appropriate vendor's contact
information.
IV. REFERRALS
1. Referral Fraud
(a) AiWin reserves the right to screen
all referrals of sales for signs of
fraud. We reserve the right, in our sole
discretion, to determine which referrals
are fraudulent, and to not disclose the
reasoning behind this decision.
(b) If suspicion of fraud is found, the
subscriber may have his or her account
placed on "hold" and would be unable to
use any of his or her credit towards any
award prizes.
V. HOLD 1. Common Reasons for Being
Placed on Hold
(a) Multiple accounts from the same
shared computer, IP location or physical
location.
(b) Fraudulent referrals.
(c) Sales being completed and
immediately canceled.
(d) More than one account at a
subscriber's shipping address and/or
shared computer.
(e) Posting information on a website,
forum, or auction that has to do with
"canceling the sales" included, but not
limited to, cancellation phone numbers,
cancellation time frames, and any
encouragement or direction to cancel the
offers after signing up with them.
(f) Providing incorrect shipping
information including, but not limited
to, country of residence.
(g) Posting your referral link in places
where it is not welcome, or spamming
your referral link online in any
capacity is strictly prohibited.
Deceptive linking is also prohibited
(i.e. leading someone to believe that
your link is an actual product rather
than information, either through stated
language or suggestive circumstance such
as charging an unreasonable amount of
money for information related to our
website.) If we see or receive
complaints about your referral methods
that we deem risky, we may place your
account or accounts on hold.
(h) The use of any software, hardware,
service or technique to hide or disguise
your identity or IP address is not
allowed. This includes the use of any
proxy server/service which is not part
of your internet service provider.
Furthermore, using an internet service
provider whose sole purpose is to
provide anonymous internet access is not
allowed.
(i) Any other reason or a combination of
reasons at the sole discretion of AiWin.
2. Additional Terms Regarding "Hold"
Status
(a) We reserve the right to place a
subscriber's account on hold at any
time.
(b) We are not responsible for notifying
a subscriber about his or her account
being placed on hold.
(c) If an account is placed on hold, all
shipment will be frozen and the
subscriber will be unable to receive any
prize item from any of the AiWin
websites.
(d) A subscriber who has had his or her
account placed on hold may not create
another account.
(e) A subscriber's account will be on
hold indefinitely. Holds do not expire.
(f) A subscriber may not receive any
reimbursement for sales or referrals
accumulated prior to being placed on
hold.
(g) If a subscriber feels that he or she
has been placed on hold in error (i.e.
has not acted against the terms of
AiWin), he or she may contact us via our
website at

(h) We reserve the right to place a
subscriber's account on hold after they
have gotten credit for a prize item, and
even after qualifying and receiving
their prize item. We also hold the right
to follow up legally on fraudulent
activities.
(i) We reserve the right to not disclose
the reasons for an account being placed
on hold.
VI. CUSTOMER SERVICE
1. Contacting Customer Support
(a) Due to the volume of customer
service requests, we do not offer
telephone support. All questions,
comments, and concerns should be sent to
us only after reading our entire
Incentive pages on our website, as many
answers to common questions can be found
in that knowledgebase.
(b) Please allow two to three business
days for responses to customer service
inquiries.
(c) In order to ensure the preservation
of account security and to promote
customer service efficiency, Subscribers
should only email us using the address
with which they signed up for this
website.
(d) We reserve the right to block any
email address.
(e) Though we accept Subscribers from
several countries, user should note that
website instructions and customer
support are only provided in English.

VII. OTHER
(a) AIWIN PROVIDES THE SERVICES AND
PRODUCTS AS IS, WITHOUT WARRANTY OF ANY
KIND, WHETHER EXPRESS OR IMPLIED. AiWin
DISCLAIMS ALL WARRANTIES OF
NON-INFRINGEMENT OF ANY THIRD-PARTY
RIGHTS, AND DISCLAIMS ALL IMPLIED
WARRANTIES, INCLUDING, BUT NOT LIMITED
TO, THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. CUSTOMER SHALL BE
SOLELY RESPONSIBLE FOR THE SELECTION,
USE, AND SUITABILITY OF THE SERVICES AND
AIWIN SHALL HAVE NO LIABILITY THEREFORE.
AIWIN DOES NOT WARRANT THAT THE
FUNCTIONS PERFORMED BY THE WEBSITE WILL
BE UNINTERRUPTED, TIMELY, SECURE OR
ERROR-FREE, OR THAT DEFECTS IN THE
WEBSITE WILL BE CORRECTED. AIWIN DOES
NOT WARRANT THE ACCURACY OR COMPLETENESS
OF THE CONTENT, OR THAT ANY ERRORS IN
THE CONTENT WILL BE CORRECTED. THE
WEBSITE AND THE CONTENT ARE PROVIDED

ASSUME ANY LIABILITY FOR THE
COMPLETENESS, ACCURACY, OR USEFULNESS OF
ANY INFORMATION DISCLOSED OR MATERIALS
ACCESSED THROUGH ITS SERVICES, ITS
SYSTEMS, ITS NETWORKS, OR THE INTERNET.
IF YOU ARE DISSATISFIED WITH THE
WEBSITE, THE CONTENT, OR THE TERMS AND
CONDITIONS, YOUR SOLE AND EXCLUSIVE
REMEDY IS TO DISCONTINUE USING THE
WEBSITE.
(c) No Waiver of Rights by AiWin.
Any failure by AiWin to enforce these
terms in every instance in which it
might apply does not amount to a waiver
of any of AiWin’s rights.
(d) Force Majeure.
AiWin shall not be liable or deemed to
be in default for any delay or failure
in performance under this Agreement or
interruption of service resulting
directly or indirectly from acts of God,
civil or military authority, acts of
public enemy, war, terrorism, riots,
civil disturbances, insurrections,
accidents, fire, explosions,
earthquakes, floods, the elements,
strikes, labor disputes, shortages of
suitable parts, materials, labor or
transportation, magnetic interference,
interruptions of electrical power or
other utility service, unavailability of
any telecommunications or wireless
service or connection to any
telecommunications or wireless service,
or any cause beyond the reasonable
control of AiWin.
(e) Enforcement/ Choice of Law/
Choice of Forum.
This Agreement will be governed by and
construed under the laws of Canada,
without reference to principles of
conflict of laws, and any action,
including, but not limited to
litigation, brought by the Parties to
enforce or interpret any provision of
this Agreement will be brought in an
appropriate provincial court in the city
and county of Vancouver, British
Columbia or the federal court for the
British Columbia, Canada. eBiz Affiliate
hereby consents to jurisdiction in such
venue and expressly waives any objection
to same.
(f) Indemnification
You understand and agree that you are
personally responsible for your behavior
on the Website. You agree to indemnify,
defend and hold harmless AiWin, its
affiliates, licensors, employees, and
agents from and against all claims,
losses, expenses, damages and costs
(including, but not limited to, direct,
indirect, incidental, consequential,
and/or exemplary damages), and
reasonable attorneys’ fees, resulting
from or arising out of your use, misuse,
or inability to use the Website or the
Content, or any violation by you of
these Terms and Conditions. |
